The appellants were the defendants in a suit brought by the respondents in Rivers State High Court, Port Harcourt. In the suit the plaintiffs claimed for (1) a dec-laration of title to a piece of land known as Ohia Amangwu, (2) damages for trespass and (3) a perpetual injunction to restrain the defendants, their servants and or agents from committing any further trespass on the land in dispute. All the claims were granted by the trial court. The defendants appealed from that decision to the Court of Appeal. The appeal was unsuccessful and it was dismissed. They therefore appealed further to this court.
